1. Scope of Application

These Terms and Conditions apply to all orders placed via the online store of Himalaya Pashmina, operated by the sole proprietor Suresh Bista, located in Berlin, Germany.

By placing an order through our website, you agree to these Terms & Conditions.

2. Contract Conclusion

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

A binding purchase contract is concluded only when we confirm your order by email or dispatch the goods.

3. Products & Authenticity

All products sold by Himalaya Pashmina are:

  • Handwoven in Nepal

  • Made from 100% pure Himalayan pashmina (cashmere),as specified.

  • Produced in limited batches using traditional craftsmanship

Minor variations in color, texture, weave, or size may occur due to the handmade nature of the products and do not constitute defects.

4. Prices & Payment

All prices listed on the website are not final prices in euros (€) and may change accordingly in future.

According to §19 UStG (small business regulation), no VAT is charged or shown.

Accepted payment methods are displayed during checkout. Payment must be completed before dispatch.

5. Shipping & Delivery

We ship within Germany and internationally.

Delivery times depend on the destination and are indicated during checkout. Delays caused by customs, force majeure, or third-party logistics providers are not our responsibility.

Shipping costs are shown separately before order confirmation.

6. Right of Withdrawal (Consumer Right)

Consumers have the right to withdraw from the contract within 30days without giving any reason.

Withdrawal Period

The withdrawal period expires 30days after the day you receive the goods.

Effects of Withdrawal

If you withdraw, we will refund all payments received from you (excluding shipping costs) within 30days after receiving the returned goods.

Return shipping costs are borne by the customer.

Products must be returned:

  • Unused

  • Unworn

  • In original condition and packaging

     

7. Exclusion of Withdrawal

The right of withdrawal does not apply to:

  • Products damaged after delivery due to improper handling

  • Products showing signs of wear or use.

8. Retention of Title

The goods remain the property of Himalaya Pashmina until full payment has been received.

9. Liability

We are liable without limitation for intent and gross negligence.

For slight negligence, we are only liable for breaches of essential contractual obligations and limited to foreseeable damages.

Liability for indirect or consequential damages is excluded unless legally mandatory.

10. Warranty

Statutory warranty rights apply.

Natural wear, aging, or changes in softness or texture due to normal use are not defects.

11. Intellectual Property

All content on this website, including:

  • Texts

  • Images

  • Designs

  • Logos

  • Product descriptions

is protected by copyright and intellectual property laws.

Any reproduction, use, or distribution without prior written permission is prohibited.

12. Data Protection

Personal data is processed in accordance with our Privacy Policy and applicable German and EU data protection laws (GDPR).

13. Governing Law & Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a merchant, the place of jurisdiction is Berlin, Germany.

14. Final Provisions

Should any provision of these Terms & Conditions be invalid or unenforceable, the remaining provisions remain unaffected.
